1. Purpose and acceptance of terms

These Terms of Service (hereinafter "Terms") govern the use of the Basmala and Basmala Kids mobile applications (hereinafter, individually or collectively, "the Application" or "the Applications"), published by MADOUI Mohamed (see section 2).

By downloading, installing or using the Application, you acknowledge that you have read, understood and unconditionally accepted these Terms in their entirety. If you do not accept these Terms, you must immediately stop using the Application and uninstall it.

For Basmala Kids, since the Application targets children under 13, acceptance of the Terms is deemed to be performed by the parent or legal guardian who installs or authorizes the use of the Application.

Hereinafter referred to as "the Publisher", "we" or "our".


3. Description of services

3.1 — Basmala

Basmala is a mobile application offering spiritual and educational audio content: Quran recitations, invocations, religious songs, and content suitable for a family audience.

3.2 — Basmala Kids

Basmala Kids is a mobile application designed for children under 13 offering:

  • Educational and spiritual nursery rhymes available in French, English and Arabic
  • Quran recitations adapted to their age
  • A playful and safe interface

3.3 — Business model

The Applications operate on a freemium model:

  • A limited selection of content is available free of charge without a subscription
  • Unlimited access to all content requires a Premium subscription (see section 8)

4. Access and identification

4.1 — No user account required

The Applications do not require any account creation (no email, no password, no social login). Access is open from the moment you download the Application from the Apple App Store or Google Play Store.

4.2 — Anonymous technical identifier

A random and anonymous technical identifier is generated locally on your device at first launch in order to deliver the service (anonymous authentication with our servers, subscription restoration). This identifier is strictly technical and is not linked to any personally identifiable data. It is detailed in our Privacy Policy.

4.3 — Geographic restrictions

The Application is available in all countries where the Apple App Store and Google Play Store offer it. The Publisher reserves the right to restrict or withdraw access in certain territories for legal, commercial or technical reasons.


5. License to use

5.1 — License grant

The Publisher grants you a personal, non-exclusive, non-transferable and revocable license to use the Application and its content, strictly limited to private, non-commercial use, in compliance with these Terms.

5.2 — License limitations

This license grants you no ownership rights in the Application or its content. You agree not to:

  • Reproduce, copy, distribute, sell, rent or sublicense all or part of the Application or its content
  • Modify, adapt, translate, decompile, disassemble or reverse engineer the Application
  • Circumvent, disable or interfere with technical protection measures (DRM, authentication, Premium access control)
  • Extract, scrape or mass-download audio content
  • Use the Application for public, commercial, promotional or collective broadcast purposes (cafés, restaurants, radio stations, schools, etc.) without prior written authorization
  • Use the Application to disseminate illegal, defamatory, hateful, obscene content or content infringing third-party rights

6. Intellectual property

6.1 — Ownership of rights

All elements comprising the Application (source code, interface, graphics, logos, "Basmala" name, "Basmala Kids" name, illustrations, avatars, icons) as well as all audio content (recitations, nursery rhymes, recordings) are protected by copyright and trademark law. They are the exclusive property of the Publisher or its rights holders (reciters, singers, authors, composers).

6.2 — Unauthorized reuse prohibited

Any unauthorized reproduction, representation, adaptation, translation, modification or exploitation of these elements, by any means whatsoever, is strictly prohibited and constitutes infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

6.3 — Third-party content

Some content (recitations, nursery rhymes) may be used under license from third parties. The rights of original rights holders are respected in accordance with the applicable license agreements.


7. User obligations

By using the Application, you agree to:

  • Use the Application in accordance with its intended purpose, these Terms, and applicable laws and regulations
  • Not use the Application to carry out illegal activities or infringe third-party rights
  • Not attempt to fraudulently access our servers, database or other users' accounts
  • Not disrupt the operation of the Application (denial-of-service attacks, injection, etc.)
  • Report any malfunction, bug or inappropriate content to support@basmala.app

8. Premium subscriptions and in-app purchases

8.1 — Subscribing to a subscription

Premium subscription is offered within the Application as an in-app purchase. It is subscribed to via:

  • Apple App Store for iOS / iPadOS devices
  • Google Play Billing for Android devices

Payment is made directly to the distribution platform (Apple or Google) according to its own terms and payment methods.

8.2 — Free trial

Some offers may include a free trial period whose duration is indicated at the time of subscription. The trial automatically ends with the billing of the first subscription cycle, unless canceled before the end of the trial period.

8.3 — Automatic renewal

Premium subscription is automatically renewed. At the end of each period (monthly or yearly depending on the chosen offer), the subscription is automatically renewed at the current price and payment is charged by Apple or Google to the payment method associated with your platform account.

8.4 — Cancellation

You may cancel the automatic renewal of your subscription at any time, free of charge and without justification. The cancellation takes effect at the end of the current paid period (you retain Premium access until that date).

How to cancel:

  • On iOS / iPadOS: Settings → [Your name] → Subscriptions → select Basmala / Basmala Kids → Cancel Subscription
  • On Android: Google Play Store → Menu → Payments and subscriptions → Subscriptions → select the Application → Cancel subscription

The Publisher does not have the technical ability to cancel a subscription on your behalf: cancellation must be performed by you directly with the platform.

8.5 — Refund

Subscriptions and in-app purchases are subject to the refund policies of the platforms (Apple and Google), which are the sole competent parties for any refund request.

Pursuant to Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a tangible medium whose performance has begun with your express consent, which is the case for Premium subscriptions once activated.

8.6 — Price changes

The Publisher reserves the right to modify subscription prices at any time. Any price change will be notified to you via the Application or by the platforms before it takes effect, with the option to cancel your subscription before the new price takes effect.

8.7 — Purchase restoration

If you change device or reinstall the Application, you may restore your Premium subscription using the "Restore my purchases" option available in the Application, provided that you are logged in with the same Apple or Google account as at the time of initial subscription.


9. 🧸 Specific provisions — Basmala Kids

9.1 — Intended for children

Basmala Kids is an Application designed for and intended for children under 13. Its use requires supervision by a parent or legal guardian.

9.2 — Parental consent to purchases

Pursuant to Article 1148 of the French Civil Code, a minor does not have the legal capacity to contract alone. Any subscription or in-app purchase in Basmala Kids must be performed and validated by a parent or legal guardian.

Apple and Google platforms impose native parental control mechanisms that block any in-app purchase without explicit parental validation:

As a parent or guardian, you are responsible for activating and properly configuring these controls on the device(s) used by the child.

9.3 — Challenging a purchase by a minor

In the event that a minor makes a purchase without the effective consent of the parent (for example if parental controls were not activated), the parent or guardian may exercise recourse with the relevant platform (Apple or Google) within the timeframes and conditions provided for by their respective policies.

9.4 — No personal data about children is collected

Basmala Kids collects no personally identifiable data about the child. The detailed terms are described in our Privacy Policy.

9.5 — No communication between children

The Application does not offer any communication feature between users (messaging, comments, chat, social sharing), ensuring a closed and safe environment.


10. Service availability

10.1 — Reasonable effort

The Publisher strives to keep the Application available 24/7, within reason and technical means at its disposal.

10.2 — Interruptions

Access to the service may be temporarily interrupted for reasons of technical maintenance, updates, backups, failure of telecommunications networks, distribution platforms, or any other event beyond the Publisher's control.

10.3 — Updates

The Publisher may at any time release updates to the Application to fix bugs, improve performance, add or remove features. Some updates may be required to continue using the Application (mandatory updates). You are encouraged to keep the Application up to date on your device.


11. Limitation of liability

11.1 — Use at your own risk

The Application is provided "as is". You acknowledge using it under your own and sole responsibility.

11.2 — Limitations

To the extent permitted by law, the Publisher shall not be liable for:

  • Indirect, immaterial, incidental damages (data loss, time loss, loss of operations, image damage)
  • Malfunctions resulting from use not compliant with the Terms
  • Damages caused by third parties (telecommunications operators, distribution platforms, internet service providers)
  • Malfunctions related to your device, its operating system, or improper configuration
  • Content provided by third parties accessible via external links (App Store, Play Store, reciters' websites, etc.)

11.3 — Liability cap

In any event, the Publisher's total liability to you, for all damages combined, shall not exceed the cumulative amount of sums actually paid by you for your Premium subscription during the 12 months preceding the event giving rise to liability. This limitation does not apply to liabilities that cannot be limited or excluded under applicable law.

11.4 — Force majeure

The Publisher may not be held liable in the event of a force majeure event as defined by Article 1218 of the French Civil Code.


12. Suspension and termination

12.1 — By the Publisher

The Publisher reserves the right to suspend or terminate your access to the Application, without compensation or prior notice, in the event of:

  • Material breach of these Terms
  • Illegal, fraudulent or abusive use
  • Persistent non-payment with a payment platform
  • Request from a competent judicial or administrative authority

12.2 — By the user

You may at any time stop using the Application and uninstall it from your device. If you have a Premium subscription, you must also cancel it with the relevant platform (section 8.4).

12.3 — Effect of termination

Termination ends your right to use the Application, without prejudice to any sums due. The provisions of these Terms which, by their nature, must survive termination (intellectual property, limitation of liability, applicable law) remain in force.


13. Personal data protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

We commit to complying with all obligations imposed by the General Data Protection Regulation (GDPR), the French Data Protection Act, COPPA (United States) for Basmala Kids, and the policies of the Apple Kids Category and Google Play Families platforms.


14. Changes to Terms

The Publisher reserves the right to amend these Terms at any time to reflect legal, technical, commercial or editorial developments.

Transparency commitments:

  • Any change is dated at the top of this document.
  • The full version history is kept and can be consulted at https://www.basmala.app/terms/changelog.
  • For any substantial change impacting your rights (pricing, termination, limitation of liability), the "Last updated" date is advanced and a summary of changes is published at the same address.

Continued use of the Application after publication of a new version of the Terms constitutes acceptance of the new version. If you do not accept the changes, you must stop using the Application and uninstall it.


15. Applicable law and dispute resolution

15.1 — Applicable law

These Terms are governed by French law, to the exclusion of conflict-of-laws rules.

15.2 — Amicable resolution

In the event of a dispute, you are invited to contact the Publisher at support@basmala.app in order to seek an amicable resolution before any contentious action.

15.3 — Consumer mediation

Pursuant to Article L.612-1 of the French Consumer Code, every consumer has the right to use, free of charge, a consumer mediator with a view to the amicable resolution of the dispute between them and a professional. The consumer may refer the matter to the mediator within a maximum period of one year from their written complaint to the professional.

15.4 — Online Dispute Resolution (ODR)

The European Commission provides an online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/

15.5 — Competent jurisdiction

Failing amicable resolution, any dispute relating to the validity, interpretation or execution of these Terms shall fall within the exclusive jurisdiction of the French courts, subject to the provisions mandatorily applicable for the benefit of the consumer.


16. Miscellaneous provisions

16.1 — Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Publisher regarding the use of the Application, and supersede any prior agreement.

16.2 — Partial nullity

If any clause of these Terms were to be declared null or unenforceable by a competent court, such nullity would not affect the validity of the other clauses, which would remain fully applicable.

16.3 — No waiver

The Publisher's failure to invoke a breach of any of the clauses of these Terms shall not be construed as a waiver of the right to invoke it subsequently.

16.4 — Additional platform terms

The use of the Application is also subject to the general terms of the distribution platforms:

In the event of a conflict between these Terms and those of the platform, the platform's terms prevail for aspects relating to distribution and payments made through the platform.
